State agency upholds ruling for Cape Wind

BOSTON ¡ª The director of the state Division of Fisheries and Wildlife has upheld an earlier finding that a wind farm proposed for Nantucket Sound will not kill or otherwise "take" endangered species under state law.

A plan by Cape Wind Associates LLC to build 130 wind turbines in the sound includes transmission lines that would run through state waters to West Yarmouth.

The state agency decided last year that its jurisdiction over the project ended 3 miles from shore, the limit of state waters and the beginning of federal jurisdiction.

Opponents of the project argued the agency's jurisdiction extended beyond the 3-mile limit regarding the impact of the wind turbines on terns and piping plovers.

Last week, Wayne MacCallum, director of the Division of Fisheries and Wildlife, upheld the earlier decision.
